Ohio has its fair share of nasty weather. Tornadoes, storms, and strong winds can wreak havoc on the oaks, maples and other trees that shade our yards.
When a tree falls and damages your property, whether it’s your house, garage, or fence, a strong homeowner’s insurance policy will protect you from the financial loss—so you can restore your home to top condition and move on.
But not all homeowner’s insurance policies are the same, and when you ask whether you’re covered, the short answer may be: “It depends.” Insurance companies will want to know what caused the tree to fall. Whether that cause is included in your policy depends on the fine print.
If you feel your fallen tree should be covered but the insurance company isn’t cooperating, having an experienced homeowner’s insurance claim lawyer can make a big difference.

Contact HNB Contact HNBSeveral factors go into filing an insurance claim for damage from a fallen tree.
The first factor is the location of the tree. If it didn’t hit a structure, there’s a chance homeowner’s insurance won’t cover its removal. But they might pay if the tree blocked an access way, such as a driveway or front walk.
If the tree was in your neighbor’s yard and damaged your home when it fell, homeowner’s insurance usually will cover your damage. If your tree falls on your neighbor’s house, then their insurance policy will likely pay.
Another factor is how the tree fell. If wind blew it over, then the wind damage clause in your homeowner’s insurance policy will cover the consequences.
An insurance company may try to deny your claim, however, arguing the tree fell because of neglect or poor maintenance.
Should a tree fall on your car, your homeowner’s insurance typically won’t cover the damage. You’ll need to go through your auto insurance.
But every disaster is unique. It can be difficult to reconstruct what happened in order to ensure you get every dollar you need to rebuild.
At HNB Law, we have an experienced team that can examine your case, visit your property, and give you the best chance to win your claim. We’ll do a preliminary assessment free of charge.

When a tree falls and causes damage, first make sure you and your family are safe.
Don’t go into the room or structure where the tree smashed a room. Don’t approach the tree until experts can get there and secure it.
Take photos and document what happened. Note the weather and wind at the time the tree fell.
Depending on where you live, you may be responsible for getting your trees inspected. If you can show your tree was healthy, not neglected, when it fell, your homeowner’s insurance shouldn’t have a reason to refuse coverage.
Insurance covers an amount agreed upon in your policy. You likely can’t get more than that. But you might need to fight with insurance, so you don’t get less.
You’ll have to pay the deductible on your policy before your homeowner’s insurance kicks in for the remaining costs.
At HNB, we have years of experience walking our clients through fallen tree homeowner’s insurance claims. We’ve secured millions in awards and settlements for Ohioans.
If you live in Cincinnati, Cleveland, Columbus, Dayton or anywhere in Ohio, we can help.
While good homeowner’s insurance protects you from damage from falling trees, they won’t pay for planting a new one. Nevertheless, we hope you do so your own home and Ohio keep looking beautiful for generations.
