    Special Note About Fence Damage: Who Pays for a Fence on a Property Line?

    In Ohio’s long agricultural history, it used to be that fences separating farms and pastures were a shared responsibility of adjacent property owners. As the state’s population grew, the laws governing fencing changed.

    In 2008, Ohio modernized its fence laws. Basically, any new fence is now the responsibility of the landowner who built it.

    For fences older than 2008, the responsibility for upkeep is assigned depending on who needs the fence and for what purpose. If both property owners use the fence, then each may be responsible for a percentage of its maintenance and care.

    Thankfully, standard homeowner’s insurance will cover sudden damage to fences. They may try to deny you, though, by claiming the damage was caused by normal wear and tear.

    That said, every situation is unique.

    Let’s imagine your neighbor’s tree falls on your fence. If a storm knocked it down, you may have to tap your own homeowner’s insurance to pay for it.     In Siding, Fence and Roof Damage Cases, What Is Ohio’s “Matching Law?”

    Insurance companies are in the business of making money, and claims for property damage hurt their bottom lines. They will often look for the least expensive way to make repairs.
