Uninsured Motorist Accident Claims in Ohio

Helping Me, That's HNB

Hurt by an Uninsured Driver? Get What’s Fair.

One of the first things you’d normally do after you’re hurt in a car accident caused by another driver is to file a claim with their insurance company.

What if they don’t have insurance?

First, it makes you mad. Someone got on the road without responsible protection in case they hurt someone.

Second, you can still pursue a personal injury claim and win compensation that helps you rebuild your life.

It’s just a little more complicated when the other driver was uninsured or underinsured. (And unfortunately, Ohio has a lot of uninsured drivers. It ranked 10th with 17.1% of its drivers uninsured in 2022, according to the Insurance Information Institute, an insurance industry group.)

When you have a run-in with an uninsured driver, talk to the Ohio personal injury lawyers at Horenstein, Nicholson & Blumenthal (HNB). We help people with uninsured motorist accident claims in Cincinnati, Columbus, Cleveland, Dayton and all over Ohio.

In fact, our Ohio injury attorneys have secured more than $500,000,000.00 in awards, benefits and settlements for injured Ohioans.

We know what you can do if the other driver is uninsured.

Afterward you’ll say, “Helping me, that’s HNB.”

How to Pursue Claims Against Uninsured Drivers in Ohio: 2 Ways

Ohio law requires all drivers to have a minimum of $25,000 in car insurance coverage for another person’s injury in a wreck, $50,000 for two or more people, and $25,000 for property damage.

If the driver who hit you doesn’t have insurance, it doesn’t mean you don’t have options.

Option 1: File a claim under your own insurance policy’s uninsured or underinsured motorist coverage.

Your insurance company will then seek to recover their costs from the other driver. This only works if you have uninsured motorist coverage on your insurance, which isn’t required, but can be a good idea to have.

And even though they’re your own insurance company, you’ve got to watch out. Your insurance company may not cooperate with you if they don’t want to pay. Your car accident attorney can negotiate with them for you.

Option 2: File a lawsuit against the negligent driver.

If they’re at fault, they’re supposed to pay. But if they didn’t pay for insurance, you might rightly wonder whether you can get much out of the other driver.

You can seek payment from seizure of the negligent driver’s assets and garnishment of their wages. Get your Ohio personal injury lawyer to help.

Getting hurt by an uninsured driver can make you feel helpless, like there’s nowhere to turn to make this situation right.

You should know that your car accident lawyer doesn’t get paid until you get paid.

What You Can Get in an Uninsured Motorist Accident Claim

Like with all personal injury claims in Ohio, even with an uninsured motorist claim, you can pursue forms of compensation like these:

    • Reimbursement for medical costs
    • Lost wages for work missed due to the accident
    • Compensation for reduced wages because of your injury
    • Coverage for long-term medical needs
    • Pain and suffering compensation

Injury claims are trickier when your accident involves an uninsured motorist, but you should still do the same things you’d do after any accident: call the police, get medical help, make sure a police report gets filed, take photos, gather evidence and get contact information for witnesses.

Make sure to get ongoing, follow-up medical care, so you can recover—and so you have medical reports and test results to back up your claim.

Don’t take your insurance company’s first offer to settle your claim. It’s probably less than you should get. Instead, have your car accident injury attorney argue for the maximum compensation.
