When Do You Have a Hit-and-Run Accident Claim in Ohio?

It’s hard to say why other drivers flee the scene of an accident. Maybe they weren’t driving their own car. Maybe they had no insurance. Maybe there was a warrant for their arrest. Maybe they were drunk.

Regardless of the reason, a hit-and-run is an attempt to dodge the consequences of negligent or reckless driving.

The victims of hit-and-run collisions could be drivers, pedestrians or bicyclists.

Ohio law defines a hit-and-run as a car crash where the at-fault driver knew the accident occurred and left the scene without providing any identifying information to the other parties or waiting for law enforcement to arrive.

Not only is that irresponsible, but it’s also illegal.

You can protect yourself from other drivers’ bad behavior.

First, call the police. Get medical help. Gather or photograph any evidence left behind at the accident scene. (More on this below.)

If the police find the at-fault driver, you can pursue a claim with their insurance company.

If they don’t find the driver, make an underinsured or uninsured motorist clam with your own insurance company if you can.

That coverage isn’t required in Ohio, but if you have uninsured motorist coverage, it could help greatly with medical costs and vehicle damage.

Of course, you may have to wrangle with the other driver’s insurance, or your own, to get the help you deserve after somebody else wronged you.

It’s frustrating. But HNB is here to take up your cause.

How To Pursue Hit-and-Run Injury Compensation

There are two immediate possible outcomes from a hit-and-run accident: the authorities find the at-fault driver, or they don’t.

You can up the chances of locating the other driver with some quick thinking right after the accident.

Try to record or remember everything about the other vehicle. What’s the color, make and model of the car?

Did you see the license plate? Did you get a glimpse of the driver? If you can take a photo with your phone as the vehicle leaves, that can help.

Call 911. Medical responders will tend to your injuries and police will file an official report that can be the beginning of your legal case.

Locate witnesses if you can. Having someone else who saw what happened will help corroborate your experience.

Once you’ve done what you can in the moment, let the police do their jobs and search for the other driver.

In the meantime, find a skilled personal injury lawyer who can help you file a claim against an at-fault driver or with your own insurance company to ensure you’re getting all the compensation available to you.

At HNB, we’re proud to hold negligent and reckless drivers accountable. After a hit-and-run injury, we can help you move on from this trauma to better times.
