Motorcycle Accident FAQs about Insurance Coverage

Finding the right insurance coverage to keep you protected is key to your peace of mind as a motorcycle owner. How much coverage you need depends on many factors, including how often you ride and what type of motorcycle you have.

Do your research and contact your insurance agent to find the right balance of coverage for you.

    What Does Motorcycle Insurance Cover?

    • Motorcycle insurance typically covers liability for any damage you may inflict on property, yourself or other people. Ohio’s minimum requirements for insurance rarely cover the full damages of a motorcycle accident because injuries tend to be serious
    • You should consider additional coverage, such as total loss coverage, underinsured and uninsured driver coverage, comprehensive coverage for all types of damage, or coverage for customized motorcycle parts. Many inadequately insured drivers are on the roads. Having the fullest coverage makes it more likely you’ll get the financial help you need to recover and get on with your life.

Should I Accept an Insurance Company’s Offer for a Settlement?

    • Never sign anything with an insurance company before talking with a motorcycle accident attorney. Insurance companies want to end claims quickly and at the lowest possible cost. A skilled attorney can negotiate a settlement that is fair for you and your family.

Does Motorcycle Insurance Differ from Car Insurance?

    • Yes. Motorcycle insurance is typically more expensive than car insurance because the risk of injury is greater. Insurance companies also tend to classify motorcycles as recreational vehicles, rather than personal or commercial. This, too, can lead to higher costs.
    • And No. Just like with cars, Ohio requires all motorcyclists to carry insurance, and the minimum requirements are the same as for cars: $25,000 for injury to one person, $50,000 for all people and $25,000 for personal property damage. Again, you’ll want to seriously consider having more than the minimum. It’s rarely enough given the potential injuries motorcyclists face.

The insurance market is complicated. That’s on purpose. The insurance company wants to sell you coverage, but they don’t always want to pay when you get hurt.

Motorcycle Accident FAQs about Your Rights and Options After an Injury

What Should I Do Immediately After a Motorcycle Accident?

    • Make sure everyone is safe. Call 911. Seek medical attention. Survey the scene and take pictures if you can. Identify witnesses. You’re starting to build a record of what happened for a successful case against an insurance company, a reckless driver, or a negligent manufacturer

How Long Do I Have to File a Claim?

    • Ohio law gives victims two years to file a personal injury claim. The countdown starts the moment the accident occurs.

What Kind of Compensation Is Available?

    • How much you’re compensated depends on your insurance coverage, who’s responsible for the accident, and how devastating your injuries are. You can pursue a claim with your insurance company, a personal injury claim against another driver, or a product liability claim against a defective motorcycle manufacturer—or all three. The legal advisers at HNB help you make the best decision about which option to take.

How Do I Know Who’s Legally at Fault for My Motorcycle Accident?

    • The simple answer is “you don’t.” That’s why it’s important to gather all the evidence and facts before casting judgment. You may worry it was your fault, but then you find out the other driver was using their cell phone or driving while impaired. Ohio is a comparative negligence state, so different amounts of blame can go to you and the other driver.

Is there Compensation when a Motorcycle Accident Is My Fault?

    • In Ohio, you cannot get compensation through a personal injury claim if the accident was more than 50 percent your fault. But if you were partially to blame but the other driver was more at fault, you could collect an award. The amount of your personal injury payment will be based partly on just how much the other party is responsible under the law.

How Does a Motorcycle Accident Lawyer Help?

    • An experienced motorcycle accident lawyer helps you gather evidence, interview witnesses, collect records, interpret insurance policies, and take a negligent driver, stubborn insurance company or shoddy manufacturer to court to get you the compensation you deserve. Your lawyer can also be your guide in making the right decisions for you and your family.

Getting fairness for you—and peace—is what we do at HNB.

Many people have unfair biases against motorcyclists, though being a biker requires you to know more about safety than they ever will.

Motorcyclists have the same rights as everyone else using Ohio’s roads and highways. HNB respects, and fights for, your rights.

In fact, we have won more than $500,000,000.00 million in awards, benefits, and settlements for injured Ohioans.
