What Is Temporary Total Disability Compensation (TTDC) in Ohio Workers’ Comp?

Helping Me, That's HNB

Hurt at Work? Act Quickly. Get Financial Help.

When you’re hurt on the job and can’t work at all, there’s a type of compensation you could get from the Ohio Bureau of Workers’ Compensation (BWC) or a self-insured employer. This compensation is set up to shield you from the financial blow of a work injury.

It’s called Temporary Total Disability Compensation (TTDC). Under the Ohio workers’ compensation system, the BWC or your employer pays TTDC directly to you when you’re out of work. It helps pay for your housing, utilities, transportation, food, childcare, and other day-to-day expenses.

TTDC helps you recoup some of your lost wages, and helps you plan how to return to work.

Keep in mind that TTDC payments are NOT earned income and thus are NOT taxable in any way by the United States government, any U.S. state, or any municipality in any state.

TTDC is available to injured workers in two situations:

  • Those who can’t work at all because of their injury or illness
  • Those who have been cleared to work under medical restrictions, but can’t work because their employer doesn’t have positions available within those restrictions

In both cases, all your medical treatment is paid for, directly to your medical providers, by your allowed Ohio BWC claim. Medical treatment is separate from TTDC when treatment requests are approved under your workers’ compensation claim.

When it comes to wage replacement, however, timing is everything.

  • For seven or fewer days missed from work, you cannot collect TTDC.
  • For eight to 14 days missed from work, you get paid TTDC for each day, but you still can’t recover the first seven days missed.
  • After you miss 14 days or more, you can then receive TTDC payment for the first seven days missed.

For the first 12 weeks off work, TTDC is paid at 72% of your Full Weekly Wage (FWW). The FWW is the average wage you earned during the six weeks prior to your work injury or illness.

After 12 weeks off work, TTDC is 66.6% of your Average Weekly Wage (AWW). The AWW is based on your average earnings during the past year (52 weeks) before your injury.

There are also other ways to calculate the FWW and AWW. They allow you to get the maximum possible TTDC payments. The work injury attorneys at Horenstein, Nicholson & Blumenthal (HNB) can help you with the calculations and get them approved so you can get paid the maximum amount.

How to Qualify for Temporary Total Disability Compensation (TTDC)

To qualify for Ohio workers’ compensation TTDC, you have to follow the process of the Ohio BWC. First, a BWC-certified doctor must either restrict you from doing any work, or place restrictions on the work that you can do while you heal.

    Then you must submit:

    • A Request for Temporary Total Compensation (C-84). You will have to submit this form to start your TTDC benefits, and again if you seek an extension.
    • A Physician’s Report of Work Ability (MEDCO-14). This is your BWC-certified doctor’s assessment of what you can or cannot do.
    • Pay stubs, W-2s, or an Injured Workers Earnings Statement from your employer to determine your weekly lost wages benefit.

A workers’ compensation lawyer can guide you through this process and make sure you don’t miss any steps.

If you run into challenges from your employer, the managed care organization (MCO) that oversees your medical treatment under the workers’ compensation system, or the BWC, the work injury team at HNB can protect your rights.

How Long Does Temporary Total Disability Compensation Last?

Temporary Total Disability Compensation is just that—temporary.

TTDC helps set you on the path to recovering and getting back to work after an accident on the job or occupational illness. It can provide a sense of normalcy. But it does eventually end.

Many times, however, the Ohio BWC or your employer wants your TTDC to end earlier than your treating physician wants it to end. It’s a common dispute that comes up between injured workers, employers and the BWC.

Here are a few ways that TTDC payments stop:

    • You’ve returned to work.
    • Your treating physician says you can return to your former position.
    • Your employer makes work available within the restrictions of your physician.
    • You’re working for any employer during the disability period.
    • You’re incarcerated.
    • You voluntarily abandon employment.

Another reason for ending TTDC payments is that you have reached what’s called, “maximum medical improvement (MMI).” In an MMI situation, you may or may not be able to go back to work, but there is medical evidence that shows your condition isn’t going to change.

    This occurs in three ways:

    1. Your BWC-certified doctor determines you’ve undergone all the treatment and recovery you can.
    2. An independent medical exam (IME)—one of the periodic exams you must take throughout your treatment—determines you’ve reached MMI.
    3. If there’s disagreement between your doctor and the IME, the Ohio Industrial Commission will hear your case and may decide you’ve reached MMI.

An Ohio workers’ compensation lawyer can stand up for your rights in a hearing before the Industrial Commission, or your lawyer can help you appeal a push by your employer or the Ohio BWC to end your TTDC benefits.

At HNB, we will be with you every step of the way and fight on your behalf when bureaucracy gets in the way of the benefits you deserve and the economic security you need to put a job injury behind you.
